US Airways CEO hoping for furlough resolution soon

SCOTTSDALE, Arizona (Reuters) - US Airways Group Chairman and Chief Executive Doug Parker said he was hopeful government leaders would come to a solution that would halt the travel disruptions in wake of U.S. staff cuts of air traffic controllers.

"It's untenable as it is," Parker said in an interview on Wednesday in Scottsdale, Arizona, where US Airways held briefings with media.

"We can't do this for long without having major disruption to the flying public. And nobody wants that. We're highly hopeful something will get resolved soon."

U.S. air travelers have endured delays at some airports this week as furloughs of air traffic controllers started. Airlines have forecast hundreds of millions of dollars in lost revenue from the furloughs that have been imposed by the Federal Aviation Administration.

The FAA has outlined plans to idle 47,000 workers for up to 11 days through the end of September as part of its plan to meet required spending curbs. Nearly 13,000 of those staffers are air traffic controllers.

The airline industry has expressed concern that delays from the furloughs could depress travel as the critical summer season gets underway.

Parker said he spent a lot of his personal time in the past week calling government officials in his carrier's hub markets to stress the need to end the furloughs.

"Everyone understands the severity of the situation," Parker said. "Good-minded people are trying to figure out ways to stop it. We don't need finger-pointing, we need solutions."

US Airways plans to merge with American Airlines parent AMR Corp this year and form the world's biggest carrier. The company said on Wednesday it expected the combination to close by the end of September.

Parker will be chief executive of the new American Airlines once the merger closes. The $11 billion all-stock merger would finalize the consolidation of legacy U.S. airlines that has helped put the industry on more solid financial footing.

The tie-up would help US Airways and American better compete with United Continental Holdings and Delta Air Lines , both the products of mergers.

Boston bomb suspects also wanted to attack New York: officials

NEW YORK/WASHINGTON (Reuters) - The two men suspected of carrying out last week's deadly Boston Marathon bombing decided after authorities identified them to drive to New York and set off additional explosives in Times Square, New York City officials said on Thursday.

Their plan unraveled only when they realized that a Mercedes sports-utility vehicle they had hijacked on April 18 three days after the bombing did not have enough gasoline for the journey, Police Commissioner Ray Kelly said.

He said investigators learned of this plan while questioning the surviving suspect, 19-year-old Dzhokhar Tsarnaev, in his hospital bed in Boston. He has been recovering from his wounds there since being captured on Friday night after an all-day manhunt that shut down much of Boston.

"Questioning of Dzhokhar revealed that he and his brother decided spontaneously on Times Square as a target," Kelly said at a news conference with Mayor Michael Bloomberg. "They would drive to Times Square that same night.

"That plan, however, fell apart when they realized that the vehicle that they hijacked was low on gas and ordered the driver to stop at a nearby gas station.

At the time, the men still had six explosive devices, including a pressure-cooker bomb of the type used at the marathon and six pipe bombs, Kelly said.

When they stopped to fill up the vehicle, the driver of the car escaped. He alerted authorities and sparked a massive late-night car chase across the university town of Cambridge, where police said the brothers shot dead a Massachusetts Institute of Technology campus police officer.

Earlier on April 18, the FBI identified the ethnic Chechen brothers as suspects in the marathon finish line bombing that killed three people and injured 264 others, releasing pictures and video of them at the scene.

The chase ended in an extended gun battle in suburban Watertown in which the suspects threw improvised explosives at police. The older suspect, 26-year-old Tamerlan Tsarnaev, was shot and died of his wounds.

Dzhokhar Tsarnaev was captured the next night in Watertown, hiding in a boat parked in the backyard of a house. Tsarnaev was formally charged on Monday in the hospital with crimes that could carry the death penalty.

His lawyer, Miriam Conrad, declined to comment on Thursday on whether her client was still talking with investigators. He is recovering from gunshot wounds in Beth Israel Deaconess Medical Center.

The U.S. Marshals Service, which is responsible for holding and transporting suspects outside of prison, declined to comment on whether or when he might be moved from the hospital.

New York's Times Square was the target of an attempted car bombing in May 2010. A Pakistan-born U.S. citizen was arrested, admitted to the plot and he is serving a life prison term.

PARENTS SAY SONS INNOCENT

Meanwhile, the father of the brothers said he planned to travel to the United States from Russia to bury his older son, Tamerlan Tsarnaev, who was killed in a police shootout.

"I am going to the United States. I want to say that I am going there to see my son, to bury the older one. I don't have any bad intentions. I don't plan to blow up anything," Anzor Tsarnaev told reporters in Makhachkala, the capital of Russia's Dagestan region.

Anzor's former wife, Zubeidat Tsarnaeva, angrily denied that her son had any role in the attack and criticized police for shooting her 26-year-old son while apprehending him.

Tsarnaeva does not plan to accompany her former husband on his trip. One factor that may have influenced Zubeidat Tsarnaeva's decision not to travel with her former husband is an outstanding arrest warrant in Massachusetts.

A warrant for Zubeidat Tsarnaeva's arrest was issued on October 25 after she failed to make a court appearance on shoplifting-related charges, according to Natick District Court Clerk Brian Kearney.

Tsarnaeva was arrested in June at a department store on suspicion of shoplifting $1,624 worth of women's dresses, according to the Natick Police Department.

Russell's lawyer, Amato DeLuca, said earlier this week that his client knew nothing about the Tsarnaev brothers' activities and is assisting authorities.

"WITCH HUNT"

In Washington, the focus remained on intelligence leading up to the Boston Marathon bombing. Tamerlan Tsarnaev had been on a federal database of potential terrorism suspects and the United States had twice been warned about him by Russian authorities. Congressional testimony earlier in the week had focused on whether the Federal Bureau of Investigation made mistakes in tracking the ethnic Chechen.

"We're in the post-event witch hunt phase, which is predictable," said James Clapper, Director of National Intelligence, at a conference in Crystal City, Virginia. "I think it would be a real good idea to not hyperventilate for a while now until we actually get all the facts."

In the most direct criticism of President Barack Obama's security policies in the aftermath of the April 15 bombing, Republican Senator Lindsey Graham told CNN he blamed the administration for failing to stop the attack.

"I just know the system is broken. The ultimate blame I think is with the administration," the South Carolina senator said, linking the bombings with last year's killing of a U.S. diplomat during an attack on a diplomatic compound in Benghazi, Libya.

"Between Benghazi and Boston, to me we're going backwards, not forward, in terms of national security," Graham said.

Ford's first quarter profit up 15 pct to $1.6b

DEARBORN, Mich. (AP) ? Ford Motor Co. reported a better-than-expected $1.6 billion profit in the first quarter as growing demand in the U.S. and China for its new vehicles helped overcome steep losses in Europe and South America.

Ford said Wednesday that first-quarter net income rose 15 percent from a year ago. Worldwide sales rose 10 percent to nearly 1.5 million.

In North America, Ford saw 25-percent gains for both its redesigned Fusion sedan and Escape SUV as well as strong sales of its F-Series trucks as home construction picks up. In China, demand for the Focus helped sales jump 54 percent in the quarter, or more than three times the industry average.

"It's a very good start to the year for us," Chief Financial Officer Bob Shanks said Wednesday.

Ford beat Wall Street's forecast with earnings of 40 cents per share, up from 35 cents in the first quarter of 2012. Analysts polled by FactSet had forecast earnings of 37 cents per share.

Without one-time charges, including restructuring costs in Europe, Ford would have earned 41 cents.

Revenue rose 10 percent to $35.8 billion, beating Wall Street's forecast of $33.5 billion.

Ford earned $2.4 billion in North America, up from $2.1 billion a year ago. It was a quarterly record for the region. In the U.S., Ford's market share jumped to 16.2 percent from 15.5 percent in the first three months of 2012, the biggest increases for any car manufacturer.

Ford's operating margin fell slightly in North America to 11 percent, from 11.5 percent in the same period a year ago. Shanks said Ford added more workers at its plants to keep up with demand. It also is selling a higher percentage of low-margin cars and small SUVs, compared with higher-profit vehicles like large SUVs, which brings down profits. U.S. buyers paid an average $32,784 for a Ford in the first quarter, or around $1,000 more than the same period a year ago, according to Internet buying site TrueCar.com.

Ford eked out a $6 million profit in its Asia Pacific and Africa region, where it is investing heavily for future growth. The company is currently building five plants in China and two in India. Sales rose 30 percent in the region to 282,000.

Those results helped offset a $462 million loss in Europe, where Ford's sales fell 20 percent during the quarter. Shanks confirmed that Ford expects to lose $2 billion in the region this year as it closes plants and brings new vehicles to the market to try to reverse declining sales.

Ford also lost $218 million in South America, where it has been hurt by currency devaluation in Venezuela. Also, sales of the Fiesta subcompact have dropped as it brings an updated Fiesta to the market.

Michael Jackson wrongful death trial to begin Monday

LOS ANGELES (Reuters) - The civil trial over the death of Michael Jackson is set to get formally underway next week after jury selection was completed on Tuesday in the $40 billion case that pits the pop star's mother against concert promoters AEG Live.

Six alternate jurors were chosen on Tuesday following the selection a day earlier of a jury of six men and six women for what is expected to be an emotional three-month trial.

The conclusion of the month-long search for a jury set the stage for opening statements to begin in Los Angeles Superior Court on Monday.

Jackson's 82-year-old mother, Katherine, is suing AEG Live, the promoters of his never-realized series of 2009 London comeback concerts, for the wrongful death of her son.

The lawsuit alleges AEG Live was negligent in hiring Dr. Conrad Murray to care for the singer while he rehearsed for a series of 50 shows.

AEG Live contends that it did not hire or supervise Murray and that Jackson was addicted to prescription drugs for years before he agreed to do the "This Is It" London concerts.

The concert promoters also argue that they could not have foreseen that Murray, who was convicted in 2011 of involuntary manslaughter in Jackson's death, posed a danger to the singer.

Jackson, 50, died in Los Angeles on June 25, 2009, from a lethal dose of the surgical anesthetic propofol that Murray was administering for sleep problems. Murray, who is not being sued, formally appealed against his criminal conviction on Monday.

Potential witnesses in the civil trial include Jackson's mother, his two oldest children, Prince, 16, and Paris, 15, as well as Murray, singers Prince and Diana Ross, and Jackson's ex-wives, Lisa Marie Presley and Debbie Rowe.

Katherine Jackson and her son's three children are seeking some $40 billion in damages from privately held AEG Live for loss of the singer's earnings and other damages. The final amount will be determined by the jury should it hold AEG Live negligent.

How one man survived a deadly avalanche

DENVER (AP) ? The sole survivor of an avalanche that killed five other men on the Continental Divide west of Denver was able to clear snow from his face with his unburied lower left arm so he could breathe, but he remained stuck for four hours until rescuers arrived, the Colorado Avalanche Information Center said Wednesday.

In its final report on the weekend accident, the center said the state's deadliest slide since 1962 was large enough to bury or destroy a car. Of the men who died in the 800-foot-wide, 600-foot-long avalanche Saturday morning, one was buried under 10 to 12 feet of snow.

The avalanche was tragic but avoidable, the center said.

The center's final report offered new details on the avalanche that occurred as snowboarders and skiers converged near Loveland Pass for the Rocky Mountain High Backcountry Gathering. The event was promoted by a Colorado snowboarding magazine as a day for backcountry riding but also avalanche gear and safety demonstrations.

The four snowboarders and a skier who died were all from Colorado. The Clear Creek County sheriff's office identified them as Christopher Peters, 32, of Lakewood; Joseph Timlin, 32, of Gypsum; Ryan Novack, 33, of Boulder; Ian Lamphere, 36, of Crested Butte; and Rick Gaukel, 33, of Estes Park.

Friends identified the survivor as Jerome Boulay of Crested Butte, who has declined requests for interviews.

All had proper avalanche equipment. At least two had avalanche airbags, and some had Avalung breathing devices but apparently were unable to use them, the report said.

"This was a really tragic accident. There's no denying that," said Ethan Greene, the center's director. "Nobody's immune from getting caught in avalanches. It doesn't matter how long you've been doing this, how athletic you are. ... Everybody can get killed. It's an equal-opportunity hazard."

The center has said the avalanche was a deep persistent slab avalanche, which occurs when a thick layer of hard snow breaks loose from a weak, deep layer of snowpack underneath. Colorado Avalanche Information Center forecasters had alerted people about the potential for such avalanches Saturday, warning of likely trigger points.

"If you find the wrong spot, the resulting avalanche will be very large, destructive, and dangerous," the forecast said.

On Saturday, Boulay and the other five men had left the parking lot of Loveland Ski Area, which wasn't affiliated with the backcountry gathering, for a one-hour tour.

They read the center's avalanche bulletin together, were aware of the deep persistent slab problem, and aimed to avoid threatening north-facing slopes as they planned to climb a few hundred vertical feet onto northwest-facing slopes, the report said.

But to get to that safer spot, they had to cross a dangerous area, Greene said. They decided to reduce the risk by leaving 50 feet between each person as they trekked. That turned out not to be enough for the large avalanche they triggered.

The group was heading for a stand of trees when they felt a large collapse and heard a "whumpf," the report said. In the seconds it took for the crack in the snow to move uphill and release the deep slab, the group ran toward the trees. Everyone but Boulay was completely buried as the group was swept into the Sheep Creek gully.

Boulay was buried except for his lower left arm, which he used to clear snow from his face. He tried to free his other arm and screamed for help.

There was no one around to hear him, the report said.

"It covered everybody. There was nobody left to call 911, nobody left to look for the buried, to help the one person who wasn't buried but couldn't get out," Greene said.

It took a while for anyone to realize the group was trapped.

Two Colorado Avalanche Information Center highway avalanche forecasters spotted the slide around 12:15 p.m. from Interstate 70. When they got to the scene about 30 minutes later, their avalanche beacons detected no signals. Even with binoculars, they couldn't see tracks heading into the slide area, the report said.

After forecasters drove back to the ski area to ask others at the backcountry gathering whether anyone might be trapped, several people rushed to the scene.

The center urges even expert backcountry enthusiasts to know the conditions, have rescue equipment and get educated on avalanches.

"We owe it to these guys to learn from a really horrible accident they were involved in," Greene said. "The only thing worse than all these guys getting killed is not to have us learn anything from it."

Suspected child kidnapper-rapist arrested in Mexico

LOS ANGELES (Reuters) - A convicted felon suspected in the kidnapping and rape of a 10- year-old California girl who was snatched from her bedroom last month was arrested early on Wednesday in Mexico and returned to Los Angeles, FBI officials said.

Tobias Dustin Summers, also a reputed member of a white supremacist street gang in the San Fernando Valley area of Los Angeles, was wanted on 37 criminal counts stemming from the March 27 kidnapping, the FBI said.

The girl was abducted from her home in the middle of the night, driven to various locations in two vehicles and raped before being dropped off near a hospital, according to police.

A passerby who saw her wandering barefoot with cuts and bruises outside a coffee shop watched over her until police were summoned.

Authorities did not provide details of the location and circumstances of Summers' capture, but FBI spokeswoman Lourdes Arocho in Los Angeles confirmed he had been taken into custody in Baja California by Mexican national police.

At an afternoon news conference, Los Angeles Police Chief Charlie Beck credited a $50,000 reward that was "highly publicized south of the border" with leading to a telephone tip that helped authorities pinpoint Summers' whereabouts.

The fugitive's identity was initially confirmed by his tattoos, which the FBI said included the Superman logo on his upper chest, police said.

FBI special agent Tim Delaney, who oversees the criminal division of the FBI field office in Los Angeles, said Summers was returned to Los Angeles after his arrest. Beck said he would be held in lieu of $19 million bond.

Police and the FBI declined to comment on media reports that the suspect was found at a Mexican drug rehabilitation center south of Tijuana. Beck had said about three weeks ago that Summers was seen in surveillance video images crossing a foot bridge into Mexico.

Summers, 32, was indicted earlier this month on one count each of kidnapping a minor, kidnapping to commit another crime and first-degree burglary, plus 34 counts of various sex offenses. He faces multiple life prison terms if convicted, according to the District Attorney's Office.

His accused accomplice, 29-year-old Daniel Martinez, who was charged with one count each of kidnapping and burglary, was arrested on March 31.

Police have said Summers has a lengthy criminal history and had served prison terms for robbery, kidnapping, explosives possession and theft. He was most recently released from state custody in July 2012 under a program designed to ease prison overcrowding in California.
