On Broad Beach, slim progress on restoring sand

Time was that Malibu's celebrity-studded Broad Beach lived up to its name. Not anymore.

In recent years, punishing winter storms and high tides have swept away much of the 1.1-mile oceanfront lined with the multimillion-dollar getaways of such notables as Steven Spielberg, Dustin Hoffman, Pierce Brosnan and businessman-philanthropist Patrick Soon-Shiong.

To protect their seaside showplaces, residents have piled sandbags and built a massive emergency rock wall. Now, under orders from state coastal officials, they are fighting against time to seek a more permanent solution ? permanent being relative in an era of rising seas and extreme weather.

They have spent millions of dollars on attorneys, engineers and environmental consultants who have scoured the coast from Mexico to Canada for a mountain of sand that could be dredged and moved to restore the beach to its original 100-foot to 150-foot width.

"The [wall] is perilously close to certain homes," said Kenneth A. Ehrlich, an attorney for the homeowners. "The homes are certainly in danger. [And] there's a bigger issue that no one seems to focus on: There's no beach right now that anyone can enjoy."

Residents contend that their motives are pure: They want to protect their homes, but they also plan to restore dunes and create an expansive public beach, all at their own expense.

The project, which appears to be the first privately funded effort of its kind, has proved far more complex than residents or regulators had imagined. As a result, residents say, they have gotten hung up on bureaucratic shoals. Manhattan Beach blocked their proposal to buy South Bay sand. Now, they have homed in on Los Angeles-owned sand from the bottom of the sea off Dockweiler Beach.

The city has yet to decide on the matter, but the Los Angeles County Department of Beaches and Harbors has objected, saying that the Broad Beach project would deplete reserves that might be needed later to replenish other public beaches eroded by rising sea levels.

A decade ago, the sandy sanctuary just northwest of Zuma County Beach was the setting for regular wrangles over access. Broad Beach homeowners erected "No Trespassing" signs and hired security guards on four-wheel ATVs. Nonresident sunbathers and picnickers complained to the California Coastal Commission that the sentries harassed them and shooed them away from public areas.

Homeowners, for their part, argued that patrols were necessary to keep people from defecating and urinating, riding horses and walking dogs on their properties.

In 2005, the surf battle took a stunning turn when Broad Beach's 108 property owners hired heavy-equipment operators to scoop up tons of wet sand from the public beach and make a berm on their properties. California Coastal Commission officials ordered a halt to the work, saying the unpermitted grading had harmed marine life and reduced the public beach.

California's access law lends itself to confusion and conflict. In Oregon and Hawaii, beaches are public to the first line of vegetation. California, by contrast, guarantees public access only seaward of the mean high tide line ? in other words, on damp sand. The Broad Beach situation is complicated by a patchwork of lateral public easements that property owners have granted in exchange for construction permits.

Further confounding matters is the array of agencies with jurisdiction over Malibu coastal waters, including the California Coastal Commission, the California State Lands Commission and the city of Malibu.

As Broad Beach has dwindled, the issue has become less about keeping the public off private property and more about saving the private property from ruin. Residents have rejected one possible solution ? moving dozens of septic systems farther inland ? as being too costly and, in some cases, unfeasible.

Conditions grew dire in the 2008-09 storm season as water churned ever closer to homes. The city of Malibu granted homeowners emergency permits to pile up sandbags for protection. Some homeowners spent as much as $60,000 on sandbags, only to see them disintegrate in the pounding waves.

Three years ago, after storm-driven tides damaged foundations and threatened to unearth seaside septic systems, the coastal commission allowed residents to build a $4-million emergency rock wall. Workers fashioned the 4,100-foot-long structure from 36,000 tons of boulders, many of them lifted by cranes over houses.

Spray occasionally splashes over the wall, and rebar is exposed in spots, posing a hazard to bathers. At high tide, waves wash over the lowest steps of the two stairways that lead over the rock wall to the beach, and strands of kelp drape over the railings.

Steve Levitan, co-creator of the TV series "Modern Family," recalls years past, when his family could leisurely stroll along the beach. Now, he said, "surfers can't get out to the good surf spots, and the homeowners can't get there, either." He must time his walks to avoid high tide. "A number of times we've had to cut up and take the street home," he said.

As a condition of granting the emergency rock wall permit, the coastal commission required Broad Beach residents to come up with a stabilization plan to be implemented by 2015. The residents' preference would be to leave the rock wall in place and use imported sand to re-create the dune system atop it and to expand the beach.

To date, homeowners say, they have spent more than $5 million of their $20-million fund preparing scientific studies and getting approvals from half a dozen different agencies, each with its own rules and regulations. They have yet to complete a formal proposal for the coastal and state lands commissions. If they keep spending at the current rate, they say, they will exhaust their funds before they can start the project.

"We have faced a bureaucratic nightmare in attempting to accomplish this project," said Marshall Grossman, a lawyer with a retreat on Broad Beach. "One would think we were attempting to build high-rise condos on a public beach."

Even if Broad Beach property owners secure the necessary sand, big questions remain for coastal officials, who say sea walls affect habitats and limit the amount of beach available for public recreation. "As sea level rises," said Charles Lester, the coastal commission's executive director, "it's only going to get more challenging to figure how to deal with that."

(AP) ? Nelson Mandela is breathing "without difficulty" after having a procedure to clear fluid in his lung area that was caused by pneumonia, the spokesman for South Africa's president said Saturday.

Mandela, the 94-year-old former president and anti-apartheid leader, had a recurrence of pneumonia, said presidential spokesman Mac Maharaj. South African officials had previously not specified that Mandela had pneumonia, saying instead that he had a lung infection.

Mandela's medical team reported that the increasingly frail ex-leader "had developed a pleural effusion which was tapped," the office of President Jacob Zuma said in a statement. "This has resulted in him now being able to breathe without difficulty. He continues to respond to treatment and is comfortable."

Pleural effusion is a buildup of fluid around the lung that can make it harder to breath. Doctors usually drain it with a tube.

The president's office thanked all who have prayed for Mandela and his family and have sent messages of support. Well-wishers included Kazempe Tambala, a street vendor in the Johannesburg township of Soweto.

"He's still our hero," Tambala said. "We wish him all the best. Get well soon, Mandela! We still love you here in Soweto."

Mandela was admitted to a hospital near midnight Wednesday night in the capital, Pretoria. It was his third trip to a hospital since December, when he was treated for a lung infection and also had a procedure to remove gallstones. Earlier this month, he spent a night in a hospital for what officials said was a scheduled medical test.

The Nobel Peace Prize laureate has been particularly vulnerable to respiratory problems since contracting tuberculosis during his 27-year imprisonment for fighting white racist rule in his country.

The elderly are especially vulnerable to pneumonia, which can be fatal. Its symptoms include fever, chills, a cough, chest pain and shortness of breath. Many germs cause pneumonia.

Many South Africans are including Mandela in their prayers on the Easter weekend, and spokesman Maharaj said expressions of concern have poured in from around the world. On Thursday, President Barack Obama said he was worried about Mandela's health, but noted he was as strong physically as he has been in leadership and character.

Mandela became South Africa's first black president in 1994 after elections were held, bringing an end to the system of white racist rule known as apartheid. After his release from prison in 1990, Mandela was widely credited with averting even greater bloodshed by helping the country in the transition to democratic rule.

Zuma's office has said doctors were acting with extreme caution because of the Mandela's advanced age.

Mandela is a revered figure in his homeland, which has named buildings and many other places after him and uses his image on national bank notes. He is also seen around the world as a symbol of reconciliation.

Young baseball pitchers shouldn't overdo it

Mar. 29, 2013 ? Baseball season has arrived, but no matter how eager young players are to get on the diamond they have to keep from overdoing it -- especially if they're pitchers.

Overhand pitching creates great forces, stresses and strains at both the elbow and shoulder. In most children up to age 16, bones, muscles and connective tissues are not fully developed, so it should come as no surprise that the pitching motion can lead to injury if it is performed too frequently.

"Parents may find it difficult to put limits on any activity that a child is good at and enjoys performing," said Michael T. Freehill, M.D., assistant professor of orthopedics at Wake Forest Baptist Medical Center. "But when it comes to pitching, the surest way to ruin a young athlete's chances of success is to allow him or her to overdo it."

Fortunately, overuse injuries are preventable. Following some basic guidelines can help young baseball pitchers stay healthy.

? Young pitchers should always warm up properly by stretching and running before throwing. Throwing should begin with easy tosses, with gradual increases in distance, then intensity.

? Youngsters should concentrate on age-appropriate pitching skills. The emphasis should be on control, accuracy and good mechanics, not curveballs and velocity.

? Tracking the number of pitches thrown is important. Staying within age-specific pitch-count limits, such as those established by Little League Baseball, is recommended.

? Proper rest periods between pitching sessions should be observed. Youngsters can still play during these rest periods, but only at positions other than pitcher and catcher.

? Children should not pitch for multiple teams with overlapping schedules or play baseball year-round.

? Children should never pitch when it hurts. They must understand that telling a parent or coach is the right thing to do if they experience discomfort while throwing.

"Following these guidelines may force a young pitcher to sit out a few innings or miss a few pitching opportunities during the season," said Freehill, who pitched in the minor leagues before attending medical school, reaching the AAA level with two different organizations and making it onto the 40-man roster of the Anaheim (now Los Angeles) Angels. "However, that's a small price to pay for keeping our kids healthy and giving them their best shot at success over the long run."

The male stray gained fame this month after barking menacingly as part of a pack of dogs at European and International Monetary Fund austerity inspectors driving up to the Finance Ministry for talks.

Ruby was later captured by municipal officials and freed Friday after being observed for two weeks and showing no signs of aggressiveness.

A city statement said Ruby's detention followed a complaint that he bit a man, and wasn't linked with the ministry incident. Dogs often follow anti-austerity protesters in Athens.

Recession-crippled Greece is being kept afloat by international bailouts, released following regular assessments of demanded cutbacks and reforms.

Everyone knows about California?s wine country and the iconic wineries in the Napa Valley and nearby Sonoma County. And certainly most visitors to the area are going to be interested in touring some of these wineries to see how they turn grapes into a product that sells for $40 a quart. But there are other options as well, from Michelin-star restaurants, bountiful markets and fancy spas to train rides, balloon flights and bike trips.

Getting around the Napa Valley is easy. There are two major north-south highways going through the valley, the Silverado Trail and Route 29.

Let?s travel through the major towns of the Napa Valley, starting in the north at Calistoga and working south through St. Helena, Yountville and Napa to the Carneros region. Each town has good hotels, excellent restaurants and notable wineries. All but Yountville have weekly farmer?s markets from May to October.

Calistoga was home to several Native American villages, drawn by the healing powers of the local hot springs. By the mid-1800s a spa resort was built and the completion of the Napa Valley Railroad allowed passengers to ferry from San Francisco and then train to Calistoga. Later a local soda fountain owner was drilling for a water well and struck sparkling water. He opened a bottling line and Calistoga Sparkling Water was begun. Also nearby is the Old Faithful of California geyser.

The town today retains a Victorian aura with historic buildings, two-lane roads and no fast-food restaurants. It was cited by the National Trust as a Distinctive Destination. The cooler hillsides produce good zinfandel and chardonnay. Local wineries include Sterling, Schramsberg and Chateau Montelena, known for winning a famous Paris wine tasting and depicted in the movie Bottle Shock. Notable high-end spa resorts include Solage Calistoga and the Calistoga Ranch. A charming in-town property is the Mount View Inn, located on Lincoln Avenue, as are virtually all the restaurants.

St. Helena has a short two-block downtown area that is one of the most picturesque anywhere and contains one-of-a-kind tourist shops and restaurants. Top wineries include Duckhorn, Charles Krug and Joseph Phelps. Resorts include the Harvest Inn, Auberge du Soleil in nearby Rutherford and Meadowood, where the restaurant has three Michelin stars.? Favorite restaurants in St. Helena include Cindy?s Backstreet Kitchen by Cindy Pawlcyn, who also has Mustards Grill in Yountville, and Terra.? Greystone Restaurant is operated by the Culinary Institute of America and staffed largely by culinary students perfecting their craft under the supervision of experienced chefs.

Yountville is a unique small town. Although its population is less than 3,000, the town boasts three Michelin-star restaurants, making it the culinary capital of wine country; arguably, it?s home to the greatest concentration of fine restaurants in the world. The first winery was built here in 1874 and operated until 1955. It is now V Marketplace, which holds shops, the Napa Style wine bar and celebrity chef Michael Chiarello?s Bottega restaurant.? The top accommodations choice is the eco-conscious Bardessono Inn and Spa right across the street. Other hotel options range from the fabulous Hotel Yountville, North Block Hotel and Vintage Inn to a variety of inns?and B&Bs.

The restaurant that really put Yountville on the map is Thomas Keller?s French Laundry, where the menu changes every day and offers a staggering number of small items. It is always rated one of the best restaurants in the world. Keller has his own herb and vegetable garden. He also operates the more casual Bouchon Bistro, Ad Hoc (designed to be for locals) and Bouchon Bakery (pastries and sandwiches). Domaine Chandon winery?s etoile restaurant and Richard Reddington?s Redd also are world-renowned. Bistro Jeanty, Redd Wood and Hurley?s would be top restaurants anywhere else.

The Rutherford and Oakville wine regions, between Yountville and Napa, are home to Caymus, Opus One, Inglenook, Plumpjack, Silver Oak, Cakebread and Robert Mondavi. The Oakville Grocery is a historic site where you can purchase whatever you need for your picnic lunch. You can even enjoy it at the picnic area out back. Inglenook is owned by Francis Ford Coppola and is the site of his home and a boutique winery. Coppola recently completed his purchase of the land that comprised the old Inglenook winery and here you can tour the winery as well as visit the museum that tells the story of winemaking, history of Inglenook and history of cinema. Far Niente Winery includes not only a winery tour but visits to its 13 acres of gardens and collection of classic cars and motorcycles.

The city of Napa, at the south end of the valley, is its commercial center. There aren?t a lot of wineries here, with the notable exceptions of Domaine Carneros and Michael Mondavi Family Estate. However, there are roughly 20 wine-tasting rooms where you can savor the vintages from a group of wineries. A Downtown Napa Wine Tasting Card offers tastings at 12 of them for 10 cents each. At the Oxbow Public Market you can taste wine, watch cooking demonstrations, and purchase artisanal cheeses, charcuterie and bread. Or grab some seafood or pizza and enjoy it on the plaza overlooking the river. There are many shops downtown, which stretches east to the river. Along the way you?ll see Napa Artwalk, a rotating temporary series of sculptures based on a theme that changes every two years.

Accommodations in Napa include the Westin Verasa, Andaz Napa, Napa River Inn, River Terrace, Meritage Resort and the Silverado Resort, located east of town in a secluded golf course community. Notable B&Bs include the Beazley House and the Inn on First. Napa also has some great restaurants. La Toque has a Michelin star and Iron Chef Masaharu Morimoto has Morimoto Restaurant here. Other great picks are Celadon, Fish Story and Hog Island Oysters at the Oxbow Market (with oysters from its own farm on the coast).

The Napa area is easy to tour by bicycle. Napa Valley Bike Tours offers self-guided bike tours on current-year Specialized bikes where you set your own itinerary. They also offer two full-day guided rides, each of which visits three or four wineries in between rides of two to four miles each. One follows roads and the other goes off-road at times to ride through the vineyards. Either way they bring you a picnic lunch and pick up your wine purchases along the way. Oklahoma warns 7,000 dental patients of HIV, hepatitis risk

OKLAHOMA CITY (Reuters) - Health officials are notifying some 7,000 people to warn they may have been exposed to HIV and other infectious diseases at an Oklahoma dental practice where improper sterilization procedures and rusty surgical tools were discovered, authorities said.

The investigation was launched after a patient of Dr. Wayne Scott Harrington of Tulsa was diagnosed with hepatitis C and HIV, the virus that causes AIDS, according to a complaint filed against the oral surgeon.

When it was determined the patient was not engaged in behavior associated with blood-borne diseases, investigators visited Harrington's office and found an array of violations, according to the complaint, filed by the Oklahoma Board of Dentistry on Tuesday.

The magnitude of the suspected violations and the number of patients involved were "unprecedented," said Susan Rogers, executive director of the Board of Dentistry, on Friday.

Harrington, 64, surrendered his license and is cooperating, officials said.

He has operated a Tulsa practice and maintained a satellite office in a suburb for about 35 years and has treated a large number of infectious disease carriers, the complaint said.

He is one of only a handful of dentists who accept Medicaid patients in the area, officials said.

The complaint says drug vials and needles were used multiple times on different patients, causing risk of cross-contamination. A separate set of instruments used for infectious disease carriers appeared rusty, it said.

The autoclave used to sterilize instruments was not being used properly and was not regularly tested, the complaint said.

Also, Harrington's drug cabinet and drug logs were in disarray, it said.

Harrington could not be reached for comment.

When he agreed to a three-year, $6 million deal with the Ravens, one of the first things Michael Huff did was text Ed Reed.

But at the same time, he doesn?t need to spend too much time trying to be Ed Reed.

But as importantly, Reed wasn?t Reed any more on the field last season, which is why they were willing to let him go become a Texan.

The Ravens weren?t going to get into a bidding war for a guy who?s turning 35 this season, allowing Houston to pay him a three-year, $15 million deal for intangibles.

So they found a player who is nearly five years younger, $9 million cheaper, and for the moment, perhaps a better fit.

Huff?s in Baltimore to play safety, but was forced into playing corner last year in Oakland. While he?s not someone you want on an island playing coverage, he can still cover ground, and that?s something the Ravens need in the middle of their new defense.

?He?s just a tremendous player, a tremendous guy,? Ravens coach John Harbaugh said. ?He fits us really well both football-wise and technique-wise, the type of person he is, the type of family man he is.

?He?s going to enable us to keep doing the things on defense that we have been doing and even build on those things. He has done it all because he?s smart, he?s tough and he knows how to play the game.?

So while the Ravens might not have the same kind of name recognition they once had on defense, they might be better. For roughly the same $41 million the Browns spent to lure outside linebacker Paul Kruger away, the Ravens have restocked by signing pass-rusher Elvis Dumervil, lineman Chris Canty and Marcus Spears and Huff, which gives them a better opportunity to live up to the reputation the old guys created.

Root Fungus Stores a Surprising Amount of the Carbon Sequestered in Soil

Falling leaves and branches are important, but roots and their fungi win out

A forest floor can store lots of atmospheric carbon, helping to limit global warming that results from carbon dioxide emissions. Most of that storage, scientists have thought, is found in tree leaves and branches that absorb carbon, eventually fall to the ground and slowly decay into soil. A new study in Sweden, however, indicates that 50 to 70 percent of the carbon bound in soil is actually from tree roots and the fungi that grow on them.

This surprising insight comes from Karina Clemmensen at the Swedish University of Agricultural Sciences and colleagues who studied boreal forests on 30 islands in northern Swedish lakes. The forests were consumed by different numbers of fires over the past 5,000 years, providing a broad mix of soil compositions on different forest floors. The comparison revealed that the amount of carbon stored in soil was linked to mycorrhizal fungi that grow along tree-root systems and help to keep them healthy.

?These fungi live in symbiosis with plant roots and transport carbon from plant photosynthesis directly into the soil,? Clemmensen wrote in response to e-mail questions. ?The prevailing dogma had been that aboveground plant litter (dead needles and wood) is the principal source of carbon storage in boreal forest soils,? she explained. But her results show that ?a large proportion of the carbon stored in boreal forests instead enters the soil from beneath, via roots and their associated mycorrhizal fungi.?

Boreal forest soils are a major sink, holding 16 percent of all carbon sequestered in soils worldwide, according to a paper by Clemmensen?s team published March 29 in Science. The most immediate implication of the finding is that climate models should be revised to take into account the role that the fungi play. Revised models, Clemmensen wrote, would give more precise predictions of how forest management practices (such as thinning of trees) and environmental changes could influence carbon storage.

More research is also needed to determine if more older trees (so-called old-growth forests) worldwide would mean increased storage. As trees age, they allocate less carbon to root fungi, yet residues from old, dead fungi hang on to carbon more tightly than do dead needles and wood in the soil. Other studies, however, suggest that mycorrhizal fungi decompose organic matter in the soil, thereby releasing carbon. How these factors interact to form stable soil ?is a very interesting and intriguing question that we do not yet have the answer to,? Clemmensen wrote. What is clear is that mycorrhizal fungi are much more important to carbon sequestration than anyone had realized.

S.Africa imports no Iranian crude again in February

JOHANNESBURG (Reuters) - South Africa did not import any crude oil from Iran for a ninth consecutive month in February, data showed on Thursday, as Pretoria steers clear of the shipments because of sanctions.

South Africa used to import a quarter of its crude from Iran but has come under Western pressure to reduce the purchases as part of sanctions aimed at halting Tehran's suspected pursuit of nuclear weapons.

In May last year, imports from Iran stood at 285,524 tonnes but since June, Africa's biggest economy has replaced the shipments with crude from other suppliers.

Saudi Arabia was again the major supplier in February with shipments of 719,330 tonnes, data from the South African Revenue Service showed. Other crude imports were from Angola, Nigeria, Russia, Yemen, Ghana and Equatorial Guinea, with shipments totalling 1.75 million tonnes.

While the United States extended South Africa's exemption from financial sanctions in December due to the Iranian cuts, Pretoria is still hampered by European Union sanctions that prevent insurance companies from underwriting Iranian shipments.

The EU has not granted any waivers, even though South Africa has been lobbying Brussels because it has to pay more to source crude from countries other than Iran.

Also, some of the South African refineries are designed to treat Iranian-type crude only and require modifications to accept other products.

Refiners in South Africa include Shell, BP, Total, Chevron, petrochemicals group Sasol, and Engen, which is majority-owned by Malaysian state oil group Petronas .

The Universe is an old neighbourhood -- roughly 13.8 billion years old. Our galaxy, the Milky Way, is also ancient -- some of its stars are more than 13 billion years old (eso0425). Nevertheless, there is still a lot of action: new objects form and others are destroyed. In this image, you can see some of the newcomers, the young stars forming the cluster NGC 2547.

But, how young are these cosmic youngsters really? Although their exact ages remain uncertain, astronomers estimate that NGC 2547's stars range from 20 to 35 million years old. That doesn't sound all that young, after all. However, our Sun is 4600 million years old and has not yet reached middle age. That means that if you imagine that the Sun as a 40 year-old person, the bright stars in the picture are three-month-old babies.

Most stars do not form in isolation, but in rich clusters with sizes ranging from several tens to several thousands of stars. While NGC 2547 contains many hot stars that glow bright blue, a telltale sign of their youth, you can also find one or two yellow or red stars which have already evolved to become red giants. Open star clusters like this usually only have comparatively short lives, of the order of several hundred million years, before they disintegrate as their component stars drift apart.

Clusters are key objects for astronomers studying how stars evolve through their lives. The members of a cluster were all born from the same material at about the same time, making it easier to determine the effects of other stellar properties.

The star cluster NGC 2547 lies in the southern constellation of Vela (The Sail), about 1500 light-years from Earth, and is bright enough to be easily seen using binoculars. It was discovered in 1751 by the French astronomer Nicolas-Louis de Lacaille during an astronomical expedition to the Cape of Good Hope in South Africa, using a tiny telescope of less than two centimetres aperture.

Between the bright stars in this picture you can see plenty of other objects, especially when zooming in. Many are fainter or more distant stars in the Milky Way, but some, appearing as fuzzy extended objects, are galaxies, located millions of light-years beyond the stars in the field of view.

Personal Health: What Causes Hearing Loss

Noise, not age is the leading cause of hearing loss. Unless you take steps now to protect to your ears, sooner or later many of you ? and your children ? will have difficulty understanding even ordinary speech.

Tens of millions of Americans, including 12 percent to 15 percent of school-age children, already have permanent hearing loss caused by the everyday noise that we take for granted as a fact of life.

?The sad truth is that many of us are responsible for our own hearing loss,? writes Katherine Bouton in her new book, ?Shouting Won?t Help: Why I ? and 50 Million Other Americans ? Can?t Hear You.? The cause, she explains, is ?the noise we blithely subject ourselves to day after day.?

While there are myriad regulations to protect people who work in noisy environments, there are relatively few governing repeated exposure to noise outside the workplace: portable music devices, rock concerts, hair dryers, sirens, lawn mowers, leaf blowers, vacuum cleaners, car alarms and countless other sources.

We live in a noisy world, and every year it seems to get noisier. Ms. Bouton notes that the noise level inside Allen Fieldhouse at the University of Kansas often exceeds that of a chain saw.

After poor service, noise is the second leading complaint about restaurants. Proprietors believe that people spend more on food and drink in bustling eateries, and many have created new venues or retrofitted old ones to maximize sound levels.

When I?m told about a new restaurant, my first question is, ?Is it noisy?? My friends and I will never return to one in which the racket makes it impossible to converse with tablemates. Perhaps the young diners the restaurateurs covet ?talk? by texting.

The ears are fragile instruments. When sound waves enter the ear, they cause the eardrum to vibrate. The vibrations are transmitted to the cochlea, in the inner ear, where fluid carries them to neatly organized rows of hair cells. These in turn stimulate auditory nerve fibers, each attuned to a different frequency. These impulses travel via the auditory nerve to the brain, where they are interpreted as, say, words, music or an approaching vehicle.

Damage to this delicate apparatus results from both volume and length of exposure to sound. Very loud noises, or chronic exposure to sound even when it is not particularly loud, can wreak havoc on hair cells, causing them to become disarranged and to degenerate.

We are born with a fixed number of hair cells; once they are dead, they cannot be replaced, and auditory sensitivity is permanently lost. Usually, sensitivity to high-frequency sounds is first to go, followed by an inability to hear the frequencies of speech.

Furthermore, the effects of noise exposure are cumulative, as Robert V. Harrison, an auditory specialist at the University of Toronto, noted recently in The International Journal of Pediatrics. Although we start out with a redundancy of hair cells, with repeated noisy insults, enough are destroyed to impair hearing. Thus, damage to hair cells incurred early in life, as has happened to many rock musicians and rock concert aficionados, can show up in midlife as difficulty understanding speech.

Sound volume is measured in decibels (dB), and the level at which noise can cause permanent hearing loss begins at about 85 dB, typical of a hair dryer, food processor or kitchen blender.

Dr. Michael D. Seidman, the director of otolaryngology at Henry Ford West Bloomfield Hospital in Michigan, told me to use ear plugs when I dry my hair or mow my lawn with a gas-powered mower, and to cover my ears when an emergency vehicle passes with siren blasting. Ear protection is a must for people who shoot guns as well as those who ride motorcycles or use snow blowers, leaf blowers, hand or pneumatic drills or chain saws.

But even noisier than many of these is the maximum output of some portable music players, which can exceed occupational safety levels and produce sound levels in the ear on a par with that of a jet taking off. If you listen to music with earbuds or headphones at levels that block out normal discourse, you are in effect dealing lethal blows to the hair cells in your ears, Dr. Seidman said.

A national study in 2006 by the American Speech-Language-Hearing Association found that among users of portable music devices, 35 percent of adults and up to 59 percent of teenagers reported listening at loud volumes.

Dr. Harrison urges purchasers of such ?personal entertainment devices? to read and heed the warnings and practical advice on package inserts. Too often people turn up the volume to overcome surrounding noise. A better plan is to set a maximum volume while in a quiet environment and never go above that.

In general, if other people can hear what you?re listening to, the volume is turned up too high. Many times I?ve had to change my seat on the subway or bus because the rider next to me was using a music player as if it were a boombox.

Some portable listening devices come with the ability to set a maximum volume, which may be worth the added cost to parents concerned about protecting their children?s ears.

At a given volume level, earbuds deliver higher noise levels than over-the-ear headphones. If earbuds are used, Dr. Harrison suggests selecting ones that fit loosely and never inserting them tightly into the ear canal. Alternatively, when you are alone and not at risk of missing important environmental cues, like an approaching vehicle, consider using noise-canceling over-the-ear headphones that block out background noise and enable you to listen at a lower volume.

Even toys meant for young children can generate ear-damaging levels of noise. The American Speech-Language-Hearing Association lists as potential hazards cap guns, talking dolls, vehicles with horns and sirens, walkie-talkies, rubber squeaky toys, musical instruments and toys with cranks. According to the association, some toy sirens and squeaky rubber toys can emit sounds of 90 dB, as loud as a lawn mower.

It suggests that parents with normal hearing test new toys before giving them to a child. ?If the toy sounds loud, don?t buy it,? is the recommendation. For noisy toys already bought, consider removing the batteries or taping over the speaker.

Chevron says executive pay to reflect 2012 "incidents"

(Reuters) - Chevron Corp said on Wednesday its executive pay would reflect certain incidents in 2012 as well as a financial performance that outpaced the U.S. oil company's peer group.

According to the Wall Street Journal, Chevron's board has trimmed equity awards by 11 percent and bonuses by at least 10 percent for Chief Executive John Watson and several other executives as a result of a string of accidents.

A Chevron spokesman declined to comment beyond the statement, which said that despite the company's strong overall performance, it had some "operating incidents" during 2012.

"These incidents were reflected in Mr. Watson's and other senior executives' compensation awards," the statement said.

Just a few months after an oil leak off Brazil in late 2011, a fire burned for weeks at a Chevron well off the coast of Nigeria in early 2012.

Then there was the fire at Chevron's oldest refinery in Richmond, California, which led to damage that has kept the plant operating at reduced capacity for more than six months.

"The board's compensation actions reflect the fact that Chevron takes management accountability seriously," the company said. "Our leadership understands that there are consequences when it doesn't meet expectations, especially in areas as critical as process safety."

Watson earned total compensation of $24.7 million (16.3 million pounds) in 2011, including $5.1 million in stock, $7.2 million in option awards and $4 million in non-equity incentives, according to a filing last April with the U.S. Securities and Exchange Commission. The equivalent filing for 2012 is due from Chevron in the next few weeks.

Jobless claims rise, but GDP data shows more growth

WASHINGTON (Reuters) - The number of Americans filing new claims for unemployment benefits rose last week, but not enough to suggest the labor market recovery was taking a step back.

Other data on Thursday showed the economy expanded at an annual rate of 0.4 percent in the fourth quarter, more than the government had previously estimated.

The reports reinforced the view that the economy perked up in the first quarter, although it still appeared vulnerable to fiscal austerity measures that kicked in early in the year.

"The underlying growth trend is showing some encouraging signs, but the key risk is how much fiscal tightening we'll see this year," said Laura Rosner, economist at BNP Paribas in New York.

While jobless claims increased more than expected last week, they have trended lower this year and remain near five-year lows. Last week, initial claims for state unemployment benefits increased 16,000 to a seasonally adjusted 357,000, the Labor Department said.

The four-week moving average for new claims, a better measure of labor market trends, rose 2,250 to 343,000.

Still, for many economists a trend reading below 350,000 level points to a firm pace of hiring in March.

"The improvement in the underlying pace of layoffs during the first three months of 2013 has been meaningful," RBS analysts said in a note to clients.

A drop in layoffs doesn't necessarily signal an increase in the pace of hiring, but Gennadiy Goldberg, an analyst at TD Securities in New York, said the trend in claims was consistent with employers adding about 195,000 workers to their payrolls in March.

That would be a slower pace of hiring than during February but still suggestive of a labor market recovery that is taking hold. The U.S. government's estimate of job growth for March - known as the non-farm payrolls report - is scheduled for release on April 5.

Investors appeared unmoved by the data. U.S. Treasuries prices fell as relative calm in Cyprus, where banks reopened under tight government control after they were shut for nearly two weeks and the island nation received a 10-billion-euro bailout, reduced safe-haven demand for low-yielding U.S. government debt. U.S. stock prices rose, with the Standard & Poor's 500 briefly trading above it October 2007 record closing high.

Despite an acceleration in hiring since mid-2012, the Federal Reserve has appeared worried that budget tightening by the government could dampen progress in the labor market. Last week, the Fed's policymakers renewed a pledge to keep buying bonds at a monthly pace of $85 billion until the labor market outlook improved substantially.

Recent data has shown the economy gathering strength. Retail sales have been stronger than expected, manufacturing output has picked up and employment growth has quickened, with the jobless rate dropping to 7.7 percent in February from 7.9 percent in January.

A report on business activity in the U.S. Midwest ran counter to this trend, with the Institute for Supply Management-Chicago business index falling to 52.4 in March. That was below analysts' expectations and pointed to slower growth.

A BIT MORE GROWTH

The U.S. Commerce Department said it increased its estimate of fourth-quarter economic growth because of a big gain in business investment and higher exports of services.

The 0.4 percent growth rate, which was the slowest since the first quarter of 2011 and far from what is needed to fuel a faster drop in the unemployment rate, was just below the 0.5 percent gain forecast by analysts in a Reuters poll.

Much of the weakness came from a slowdown in inventory accumulation and a sharp drop in military spending. These factors are expected to reverse in the first quarter, when many economists see an economic growth rate closer to 3 percent.

The fourth-quarter rate was, however, higher than the government's previous estimate of a 0.1 percent gain. Compared with the overall economy, consumer spending growth looked a little more robust, expanding at a 1.8 percent annual rate.

Thursday's report is the government's third estimate of growth for the final three months of 2012. In the first estimate, the government shocked economists by saying the economy shrank at a 0.1 percent annual rate.

The reasons for the meager pace of economic activity were mostly as initially estimated.

Inventories subtracted 1.52 percentage points from the GDP growth rate in the fourth quarter, a bit less of a drag than in the second GDP estimate, which was published on February 28. Defense spending plunged at a 22.1 percent rate, shaving 1.28 points off growth as in the previous estimate.

There were some bright spots in the fourth quarter, however. The report showed business investment rose at a 13.2 percent rate, a bigger gain than initially estimated. The extra growth was mostly from more construction spending by businesses.

High court hears case on federal benefits for gays

WASHINGTON (AP) ? In the second of back-to-back gay marriage cases, the Supreme Court turned Wednesday to a constitutional challenge to the law that prevents legally married gay Americans from collecting federal benefits generally available to straight married couples.

A section of the 1996 Defense of Marriage Act says marriage may only be a relationship between a man and a woman for purposes of federal law, regardless of state laws that allow same-sex marriage.

Lower federal courts have struck down the measure, and now the justices, in nearly two hours of scheduled argument Wednesday, will consider whether to follow suit.

A somewhat smaller crowd gathered outside the court Wednesday, mainly gay marriage supporters who held American and rainbow flags. One man wore a rainbow flag as a cape. "Two, four, six, eight, we do not discriminate," a group chanted at one point.

The DOMA argument follows Tuesday's case over California's ban on same-sex marriage, a case in which the justices indicated they might avoid a major national ruling on whether America's gays and lesbians have a right to marry. Even without a significant ruling, the court appeared headed for a resolution that would mean the resumption of gay and lesbian weddings in California.

Marital status is relevant in more than 1,100 federal laws that include estate taxes, Social Security survivor benefits and health benefits for federal employees. Lawsuits around the country have led four federal district courts and two appeals courts to strike down the law's Section 3, which defines marriage. In 2011, the Obama administration abandoned its defense of the law but continues to enforce it. House Republicans are now defending DOMA in the courts.

Same-sex marriage is legal in nine states and the District of Columbia. The states are Connecticut, Iowa, Maine, Maryland, Massachusetts, New Hampshire, New York, Vermont and Washington. It also was legal in California for less than five months in 2008.

The justices chose for their review the case of Edith Windsor, 83, of New York, who sued to challenge a $363,000 federal estate tax bill after her partner of 44 years died in 2009.

Windsor, who goes by Edie, married Thea Spyer in 2007 in Canada after doctors told them that Spyer would not live much longer. She suffered from multiple sclerosis for many years. Spyer left everything she had to Windsor.

There is no dispute that if Windsor had been married to a man, her estate tax bill would have been zero.

The U.S. 2nd Circuit Court of Appeals in New York agreed with a district judge that the provision of DOMA deprived Windsor of the constitutional guarantee of equal protection of the law.

Like the Proposition 8 case from California, Windsor's lawsuit could falter on a legal technicality without a definitive ruling from the high court.

The House Republicans, the Obama administration and a lawyer appointed by the court especially to argue the issue were to spend the first 50 minutes Wednesday discussing whether the House Republican leadership can defend the law in court because the administration decided not to, and whether the administration forfeited its right to participate in the case because it changed its position and now argues that the provision is unconstitutional.

If the Supreme Court finds that it does not have the authority to hear the case, Windsor probably would still get her refund because she won in the lower courts. But there would be no definitive decision about the law from the nation's highest court, and it would remain on the books.

On Tuesday, the justices weighed a fundamental issue: Does the Constitution require that people be allowed to marry whom they choose, regardless of either partner's gender? The fact that the question was in front of the Supreme Court at all was startling, given that no state recognized same-sex unions before 2003 and 40 states still don't allow them.

But it was clear from the start of the 80-minute argument in a packed courtroom that the justices, including some liberals who seemed open to gay marriage, had doubts about whether they should even be hearing the challenge to California's Proposition 8, the state's voter-approved gay marriage ban.

Justice Anthony Kennedy, the potentially decisive vote on a closely divided court, suggested the justices could dismiss the case with no ruling at all.

Such an outcome would almost certainly allow gay marriages to resume in California but would have no impact elsewhere.

There was no majority apparent for any particular outcome, and many doubts were expressed by justices about the arguments advanced by lawyers for the opponents of gay marriage in California, by the supporters and by the Obama administration, which is in favor of same-sex marriage rights. The administration's entry into the case followed President Barack Obama's declaration of support for gay marriage.

On the one hand, Kennedy acknowledged that same-sex unions had only become legal recently in some states, a point stressed repeatedly by Charles Cooper, the lawyer for the defenders of Proposition 8. Cooper said the court should uphold the ban as a valid expression of the people's will and let the vigorous political debate over gay marriage continue.

But Kennedy pressed him also to address the interests of the estimated 40,000 children in California who have same-sex parents.

"They want their parents to have full recognition and full status," Kennedy said. "The voice of those children is important in this case, don't you think?"

Yet when Theodore Olson, the lawyer for two same-sex couples, urged the court to support such marriage rights everywhere, Kennedy feared such a ruling would push the court into "uncharted waters." Olson said the court similarly ventured into the unknown in 1967 when it struck down bans on interracial marriage in 16 states.

Kennedy challenged the accuracy of that comment: He noted that other countries had had interracial marriages for hundreds of years.

The justice also made clear he did not like the rationale of the federal appeals court that struck down Proposition 8, even though it cited earlier opinions in favor of gay rights that Kennedy had written.

That appeals court ruling applied only to California, where same-sex couples briefly had the right to marry before the state's voters in November 2008 adopted Proposition 8, a constitutional amendment that defined marriage as the union of a man and a woman.

Reflecting the high interest in the cases, the court planned to release an audio recording of Wednesday's argument shortly after it concludes, just as it did Tuesday.
